A California-based chemical company has been indicted by federal prosecutors on charges of that allege the company smuggled hazardous chemicals into the country and conspired to defraud the U.S. government. Federal prosecutors announced on Friday that charges are being brought against Peiwen Zhou, the 53-year-old CEO of AK Scientific, Inc., based in Union City. California.

Dietary Supplement Manufacturer Prevails in Prop. 65 Trial

Sometimes a simple and straightforward defense works best in litigation.  However, simplicity has been an underutilized tactic in the few Proposition 65 bench trials tried in recent years.  
Dietary supplement maker Aloe Vera of America Inc. opted to use two legal theories in its defense in a recent Prop. 65 trial held in San Francisco Superior Court.  The supplement maker based its main defense on the Proposition 65 Safe Harbor level for lead, and asserted a secondary affirmative defense that Proposition 65 is preempted by federal law.

Gree Hammered with Maximum CPSC Civil Penalty

Humidifier manufacturer Gree will pay the maximum civil penalty of $15.45 million in a CPSC settlement accepted by commissioners by a vote of 4-1.

 

Commissioner Ann Marie Buerkle was the only commissioner that voted against imposing the maximum penalty. Buerkle has not supported severe penalties in recent agency enforcement actions.

Soft drink and snack food giant PepsiCo has agreed to lower its levels of 4-MEI (4-Methylimidazole) in its soda products as part of a settlement with Proposition 65 citizen enforcement group the Center for Environmental Health (CEH).  
Pepsi’s agreement requires PepsiCo to lower levels of 4-MEI in its soda products sold in California by January 1, 2016.
The chemical compound 4-MEI is a chemical byproduct formed when caramel coloring class III and IV are produced.
