California Attorney General Kamala Harris has proposed several amendments in response to public comments submitted following the release of the Attorney General’s Proposition 65 litigation reform proposal, and the public hearing that took place in November at the Dept. Of Justice headquarters in Oakland.
The modified proposal includes:
● the addition of a proposed definition of “private enforcer”;
● Clarification of the determination of whether a product reformulation will “confer a significant benefit on the public”;
● Addition details on required disclosure of economic interest in settlements.
The modified proposal does not appear to address the many public comments that said the reforms proposed do not go far enough, however.
A total of 21 stakeholder organizations submitted public comments on the initial litigation reform proposal.
