 CPSC Proposes Phthalate Restriction for Childrens Products  

The U.S. Consumer Product Safety Commission (CPSC) has drafted a proposed rule that would prohibit children’s toys and childcare articles sold in the United States from containing certain phthalates according to a report released by the Toy Industry Association (TIA). The CPSC will hold a briefing on December 5 and vote on the proposal on Dec. 17.

 OEHHA Intends to List Drug Used to Treat MS as a Prop 65 Carcinogen   Mitoxantrone hydrochloride has been identified by the US Food and Drug Administration (FDA) to require specific labeling communicating the risk of cancer.  FDA developed labeling language for mitoxantrone hydrochloride in 2012.

 Gov. Brown Appoints Barbara Lee as New DTSC Director   Gov. Edmund G. Brown has appointed Barbara Lee as Director of the California Department of Toxic Substances Control (DTSC). Lee served as air pollution control officer for the Northern Sonoma County Air Pollution Control District since 1996, where she was supervising air quality engineer from 1994 to 1996.

 Prop 65 Warning Labels Recommended by Toy Industry Association    The Toy Industry Association is recommending that its members include warning labels on products containing diisononyl phthalate (DINP).  The trade group notes that no “safe harbor” level for DINP has been established by California’s Office of Environmental Health Hazard Assessment (OEHHA) since the chemical was listed.

 Prop 65 Lawsuit Alleges Wheat Bread Exposes Consumers to Urethane  

Supermarket giant Kroger has been sued for allegedly selling wheat bread containing high levels of a Proposition 65 carcinogen without a warning on the packaging, according to a lawsuit filed in Los Angeles County Superior Court on August 22.
