A Fresno Superior Court Judge has issued a tentative ruling to dismiss a lawsuit filed by agrochemical and biotech giant Monsanto’s January 2016 lawsuit to block the California Office of Environmental Health Hazard Assessment’s (OEHHA) proposed listing of Glyphosate (CAS No. 1071-83-6), the active ingredient in Monsanto’s Roundup pesticide products.
The agency proposed the listing of Glyphosate as a carcinogen under Proposition 65 in September 2015 by the controversial Labor Code Listing mechanism. The basis for the proposed listing was a determination by the World Health Organization’s International Agency for Research on Cancer (IARC) which classified Glyphosate as "probably carcinogenic to humans (Group 2A)" in March 2015.
Fresno Superior Court Judge Kristi-Culver-Kapetan is expected to issue a final ruling in the coming weeks.
